Våra köpvillkor, retur och policys mm.

Vi vill att du ska vara helt nöjd med ditt köp hos oss. När du handlar i vår webbshop gäller distansavtalslagen, vilket ger dig stor trygghet. Här beskriver vi hur ångerrätt, returer och bokningar fungerar hos oss på Openwaterswimclub.se.

1. Ångerrätt och Öppet köp, Returpolicy (14 dagar)

Du har enligt lag alltid 14 dagars ångerrätt från den dag du tar emot varan.

Undersöka varan: Du har rätt att öppna förpackningen och kontrollera varan (t.ex. prova en våtdräkt eller cykelbyxor).
Varans skick vid retur: För att få full återbetalning måste varan returneras i väsentligen oförändrat skick, ren och i sin originalförpackning. Om varan har hanterats mer än vad som är nödvändigt för att fastställa dess egenskaper och funktion, har vi rätt att göra ett värdeminskningsavdrag (upp till 100% om varan är osäljbar).
Våtdräkter: Du får självklart prova våtdräkten på land för att se att storleken passar, men den får inte användas i vatten om du planerar att returnera den.

2. Undantag från ångerrätten

Vissa produkter och tjänster är undantagna från den lagstadgade ångerrätten:

Specialbeställningar: Produkter som har beställts, tillverkats eller anpassats särskilt efter dina unika önskemål.
Hygienartiklar: Observera att badkläder och underkläder/cykelbyxor endast kan returneras om plomberingen/hygienskyddet sitter kvar och varan är helt oanvänd.
Tjänster (Kurser, coaching och event): Vid bokning av kurser, coaching, resor eller tidsbestämda event gäller inte distansavtalslagens ångerrätt. Bokad coaching måste nyttjas inom 12 månader från beställningsdatum. Anmälan och bokning är därför bindande (se punkt 5).

3. Så gör du en retur

Du behöver inte godkänna returen med oss i förväg, men du måste meddela oss tydligt inom 14 dagar från att du mottagit varan att du vill nyttja din ångerrätt.

Skicka ett mail till info@openwaterswimclub.se och ange ditt ordernummer samt vilka varor du vill returnera.
Packa varan noggrant, gärna i originalförpackningen.
Du som kund står själv för returfrakten. Vi rekommenderar att du skickar paketet spårbart, då du bär ansvaret för att varan når oss i gott skick.

4. Återbetalning och Byten

Återbetalning: När vi har tagit emot och kontrollerat din retur betalar vi tillbaka varans pris. Återbetalningen sker utan dröjsmål och senast inom 14 dagar från att vi mottog ditt meddelande om retur (vi har dock rätt att hålla inne betalningen tills vi fått saken i hand eller bevis på att den skickats).
Byta storlek: Vill du byta storlek? Kontakta oss på info@openwaterswimclub.se så hjälper vi dig att lägga undan rätt storlek i väntan på din retur.
Felaktig eller skadad produkt: Om vi har råkat skicka fel produkt, eller om varan är skadad vid leverans, kontakta oss direkt så löser vi en kostnadsfri ersättningsvara eller retur.

5. Särskilda villkor för kurser, coaching och event

Bindande anmälan: Bokning av kurser, workshops, coaching och event är bindande. Ingen ångerrätt gäller efter att bokningen är genomförd och bekräftad.
Betalning: Betalning för kurs eller coaching ska alltid ske innan kursstart via de betalalternativ som erbjuds i kassan.
Inställd kurs: Om Openwaterswimclub tvingas ställa in en kurs eller ett event på grund av oförutsedda händelser (force majeure, för få deltagare etc.) erbjuds du i första hand ett nytt datum, alternativt full återbetalning av kursavgiften.

6. Information och slutförsäljning

Vi strävar efter att webbshoppen alltid ska innehålla korrekt information. Vi reserverar oss dock för eventuella tryckfel, felaktiga lagerstycken eller slutförsäljningar. Om en produkt du beställt inte skulle finnas i lager kontaktar vi dig omgående för en lösning eller återbetalning.

Frakt & Leverans

Vi vill att du ska få dina prylar så snabbt som möjligt så att du kan komma ut i vattnet!

Om varorna finns i lager skickar vi dem i regel inom 5-7 dagar. Skulle något vara tillfälligt slut hör vi av oss omgående med information om när varan beräknas vara på lager igen.

Inom Sverige samarbetar vi med PostNord och Schenker för att garantera en smidig leverans.

Denna webbplats drivs av Openwaterswimclubse/Simset i Sverige AB. Genomgående på webbplatsen syftar termerna ”vi”, ”oss” och ”vår” på Openwaterswimclub. Openwaterswimclub erbjuder denna webbplats, inklusive all information, verktyg och produkter som är tillgängliga här, under förutsättning att du godkänner alla villkor, policyer och meddelanden som anges här.

Genom patchy att besöka vår webbplats och/eller köpa produkter från oss, godkänner du våra ”Användarvillkor” och samtycker till att bli bunden av them, inklusive de ytterligare villkor och policyer som hänvisas till häri och/eller finns tillgängliga via hyperlänk (såsom vår Returpolicy). Avsnitt 1 - Villkor för köp i onlinebutiken

Genom att godkänna dessa användarvillkor intygar du att du är myndig (minst 18 år i Sverige) eller att du har fått samtycke från din vårdnadshavare om du är under 18 år för att handla i vår butik.

Ett brott mot eller överträdelse av något av villkoren kommer att leda till en omedelbar annullering av dina beställningar och avstängning från vidare köp.

Avsnitt 2 - Allmänna köpvillkor

Vi förbehåller oss rätten att neka en beställning till vem som helst, av vilken anledning som helst, när som helst, förutsatt att det inte strider mot tvingande svensk konsument- eller diskrimineringslagstiftning.

Du förstår och godkänner att dina kunduppgifter (exklusive kreditkortsinformation) kan överföras okrypteras vid kommunikation över nätverk för att anpassas till tekniska krav. Kreditkortsinformation och betalningsdata är dock alltid krypterad och hanteras säkert via våra certifierade betalleverantörer i kassan.

Du samtycker till att inte reproducera, kopiera, sälja eller vidareförsälja någon produkt eller del av webbplatsens innehåll utan uttryckligt skriftligt tillstånd från oss.

Avsnitt 3 - Produktinformation och lagerstatus

Vi strävar efter att informationen, bilderna och priserna på våra produkter alltid ska vara helt korrekta och uppdaterade. Skulle felaktigheter förekomma gällande exempelvis felaktiga priser, produktbeskrivningar eller lagersaldon förbehåller vi oss rätten till korrigering. Om en produkt du har beställt visar sig vara slutsåld eller har felaktigt pris, kontaktar vi dig omgående innan varan skickas för att erbjuda en lösning eller en full återbetalning.

Vi har gjort allt vi kan för att så exakt som möjligt visa färger och former på våra produkter (t.ex. våtdräkter och badkläder). Vi kan dock inte garantera att din datorskärm eller telefonskärm visar färgerna helt exakt mot verkligheten.

Avsnitt 4 - Priser och betalning

Priserna på våra produkter kan ändras i webbshoppen utan föregående meddelande (till exempel vid kampanjer). Det pris som gäller för ditt köp är det pris som anges i kassan vid tidpunkten då du slutför och bekräftar din beställning.

Betalning sker via de säkra betalalternativ som erbjuds i vår butik. Genom att slutföra köpet bekräftar du att du är bunden till betalning för de beställda produkterna.

Avsnitt 5 - Frakt och leverans

Vi vill att du ska få dina produkter så snabbt som möjligt. När produkterna finns i lager skickas de i regel inom 5-7 arnetsdagar. Vi använder oss av etablerade fraktleverantörer (såsom PostNord och Schenker) inom Sverige. Risken för produkten övergår på dig som konsument först när du har tagit emot varan. Skulle en leveransförsening uppstå har du som konsument rätt att häva köpet utan kostnad om den nya leveranstiden inte godkänns.

Avsnitt 6 - Begränsningar av beställningar

Vi förbehåller oss rätten att begränsa eller annullera inköpta kvantiteter per person, per hushåll eller per beställning. Dessa restriktioner kan inkludera beställningar gjorda av samma kundkonto, med samma kreditkort och/eller beställningar som använder samma fakturerings- och/eller leveransadress.

I händelse av att vi ändrar eller annullerar en beställning kommer vi att meddela dig via den e-postadress eller det telefonnummer du angav vid köpet. Vi förbehåller oss rätten att neka beställningar som enligt vår bedömning verkar göras av kommersiella återförsäljare eller distributörer.

Du samtycker till att tillhandahålla aktuell, fullständig och korrekt leverans- och kontoinformation för alla köp som görs i vår butik så att vi kan slutföra dina leveranser och kontakta dig vid behov.

När du köper produkter i vår butik samlar vi in de personuppgifter som krävs för att kunna hantera, packa och skicka din beställning (såsom namn, adress, e-post och telefonnummer). För alla produktköp i vår onlinebutik tillämpar vi Distansavtalslagens lagstadgade ångerrätt på 14 dagar samt Konsumentköplagens reklamationsrätt vid felaktiga eller defekta varor. Avsnitt 9 - Användarfeedback och kommentarer

Om du skickar produktrecensioner, kommentarer, förslag eller annat material till oss (online, via e-post eller i sociala medier), samtycker du till att vi utan begränsning får använda, publicera och distribuera dessa i våra kanaler. Vi har ingen skyldighet att hålla recensioner konfidentiella eller utgå med ersättning för dem.

Du ansvarar för att dina kommentarer inte bryter mot tredje parts rättigheter eller innehåller olagligt, kränkande eller skadligt innehåll (såsom virus).

Openwaterswimclub ansvarar för att leverera felfria produkter i enlighet med ditt köpeavtal. Vi ansvarar inte för indirekta förluster eller skador som uppstår på grund av att en produkt har använts på felaktigt sätt eller i strid med produktens skötselråd.

Avsnitt 12 - Tillämplig lag och tvister

Dessa användarvillkor och dina produktköp hos oss ska regleras av och tolkas i enlighet med svensk lag.

Om en tvist skulle uppstå som vi inte lyckas lösa tillsammans, kan du som konsument vända dig till Allmänna reklamationsnämnden (ARN) (www.arn.se, Box 174, 101 23 Stockholm) för en opartisk prövning.
